Kirk Brett is chair of the Firm’s Bankruptcy Department, co-chair of the Distressed Real Estate Practice Group, and a member of the Restructuring and Workouts Practice Group and the Litigation Practice Group.

 

Mr. Brett has represented clients having a variety of positions, interests and goals in cases covering a wide spectrum of industries.  As a result, Mr. Brett is equally skilled in representing clients in transactional matters as well as in litigation.

 

Prior to joining the Firm in 2001, Mr. Brett practiced at Schulte Roth & Zabel, Donovan Leisure Newton & Irvine, and Rosenman & Colin, now known as Katten Muchin Rosenman.

 

Mr. Brett routinely advises venture capital and hedge funds, landlords, creditors, and other interested parties in real estate-related and other distress situations.  Mr. Brett also advises prospective purchasers of distressed businesses, leases, debt and other assets.  Further, Mr. Brett has represented chapter 11 debtors and creditors’ committees in large and complex bankruptcy cases.  Consequently, Mr. Brett has been actively involved in some of the country’s most significant bankruptcy cases.

 

Mr. Brett has investigated and litigated issues of fraud and fraudulent conveyance and a host of other bankruptcy and insolvency-related issues.  Mr. Brett has also litigated commercial breach of contract, intellectual property, licensing, professional liability, and corporate governance disputes in a variety of federal and state courts.

 

Mr. Brett’s skills and background have been in particular demand in connection with distressed real estate.  In that regard, Mr. Brett’s expertise is invaluable in advising the Firm’s clients on the risks of dealing with companies that are at risk of future bankruptcy and, of course, guiding the Firm’s clients in their dealings with bankrupt entities.

 

Mr. Brett graduated from Trinity College with a B.S. in 1988 and from Hofstra University School of Law with a J.D. in 1991.  At Trinity College, he majored in chemistry and was captain of the diving team.  At Hofstra Law School, Mr. Brett was a member of the Hofstra Law Review and the recipient of the Deborah Sloyer Trial Advocacy Award.  Mr. Brett is admitted to practice before all courts in the State of New York, the United States District Courts for the Southern and Eastern Districts of New York, and the United States Court of Appeals for the Second Circuit.
